Our innovative phased investigation approach ensures we can maximise recoveries whilst keeping costs proportionate and ensuring that only appropriate cases are escalated for administration or legal action.

Our approach has at its heart the fact that as a creditor if your debts are not paid from available assets in the estate you have a range of options to ensure payment is secured. Those options may include taking steps to administer an estate as a creditor, taking action against a third party who has incorrectly taken funds from an estate or simply taking action against existing executors or administrators who have failed to fulfil their obligations of paying the debts owed by the deceased.

Our phased approach allows us to cost effectively identify cases where firstly a recovery is possible, engage with the deceased next of kin or representatives regarding the resolution of any disputes and ultimately if an amicable resolution cannot be achieved taking appropriate legal action to protect your position as a creditor and secure a recovery.

The majority of cases we deal with ultimately resolve without us having to take formal legal action.

Our approach to cost on these matters is on the basis that we share the risk of action with you. Beyond just a traditional Conditional Fee Agreement where we charge our fees when a recovery has been made we have developed a range of pricing scenarios aimed at ensuring that the costs of action remain proportionate to the debt and also that there is a true fair balance between what you recover and the costs we charge.
