Complex Litigation and Insolvency

The long established CS Litigation team is made up of Partners, Solicitors, Trainee Solicitors, and paralegals amongst others and deals with complex debt recovery and commercial litigation cases.

As well as our bulk legal expertise our CS Litigation team have developed a wealth of knowledge dealing with the broad range of complex utility matters including complex large industrial and commercial accounts with multi-sites, matters involving third party brokers and allegations of fraud where the third party intermediary has misled the customer for example.

We have also been involved in urgent matters where legal action was required to protect client interests, Examples have included cases involving sites with cannabis farms, and a case involving customers providing incorrect meter readings over an extended period leading to substantial rebilling and a debt of over £6 million, and various unmetered supply cases.

Our CS Litigation team also have extensive experience in dealing with insolvency matters including taking insolvency action on behalf of our utility clients acting on both routine winding up and bankruptcy petition matters as well as disputed insolvency cases.

Given the nature of the cases dealt with by our CS Litigation team we are often required to approach cases on the basis that you may wish to preserve the commercial relationship with the customer despite the accrued debt. We will work with you to understand your objectives and tailor our approach flexibly to ensure we adopt the right tone and engagement pathway.

The team includes partner Uday Patel who currently heads the team and Rachel Addai also a Partner and the overall head of J&P Credit Solutions.
