The CS Litigation Team is made up of Partners, Solicitors, Trainee Solicitors amongst others and deals with complex debt recovery and commercial litigation cases. The team sits uniquely between the various parts of the CS division, providing preliminary advice at early stages of collections or legal activity, dealing with litigation flowing from claims issued by the Claims and Enforcement team and complex recovery and commercial litigation matters.

In the current climate it is vital for the team to do much more than deliver a litigation service. Given the cost of litigation the team regularly gets involves in matters referred direct well before the client has settled on issuing proceedings. The aim of the team on these early referrals is to resolve matters without the need for litigation. The team is trained to engage and negotiate and assist with the full range of alternative dispute resolution mechanisms.

Where it becomes necessary the team deals with issuing proceedings and dealing with the full range of defended matters along with counterclaims that may arise. As well as conventional proceedings issued in either the county or high courts, the team also deals with the full range of insolvency matters.

With our wealth of experience of dealing with complex matters we will clearly advise you at the outset as to the appropriate litigation strategies to apply and the realistic likelihood of and scale of any positive outcome. Notable among the partners that lead the team are Uday Patel who currently heads it up, along with Rachel Addai, the overall head of J&P Credit Solutions. All of the partners in the team have considerable experience of working for public sector clients and Rachel Addai is particularly known for her expertise in dealing with complex public sector recoveries and is regular sponsor and speaker at events such as the Local Authority Civil Enforcement Forum (LACEF) conference and the London and South East Credit Circle (LSECC), as well as working in a consulting capacity for several major London local authorities.
